My understanding is that if the person was photographed in a public place, then no release is necessary. But then I'm not a lawyer either.:cool:

That may hold up for editorial use [note the word "may"], but there is also the issue of recognizability of the subject. Mind you--I don't shoot a lot of uncommissioned editorial work work, so this has not been a major issue for me...my comments about how I run my business stand: No release--no publication--and that includes my website.
